WHAT IS THE DUTY OF VIGILANCE?
Stemming from Article D8222-5 of the French Labor Code, which came into force on January 1, 2012 and aims to combat undeclared work, the duty of vigilance requires all contracting parties to collect and verify the authenticity of the following documents:
• A document proving the company's registration
• A vigilance certificate issued by Urssaf, certifying that the company is up to date with its social security obligations as of the contract's signing
• A sworn statement regarding the employment, or not, of foreign workers from outside the European Economic Area (EEA)
This process must be carried out with every supplier in the supply chain and renewed every 6 months.
